An assessment of the impact of the Supreme Court’s judgment in Ahmed v Lifestyle [2024] UKSC 17, which significantly changed the Court’s previous approach to accessory liability (joint tortfeasorship) in respect of strict liability torts. The judgment moves away from treating accessory liability as a “strict liability” issue in its own right and now requires the defendant to have knowledge that their actions would result in the tort – whether by procuring the tort or acting to a common design – or by having chosen to turn a blind eye to the possibility of wrongdoing. The webinar will also consider how the judgment impacts on accounts of profits sought against directors pursued for accessory liability in IP right infringement cases.
