Supplementary protection certificates (SPCs) are an oft discussed, highly contentious area of patent law. The discussion often relates to the relative lack of clarity associated with the case law surrounding SPCs. In this webinar, rather than discussing the case law itself, we will focus on the practicalities of obtaining an SPC and how the case law impacts on the process for filing and obtaining an SPC. To this end, Stewart will discuss the basics of SPCs, including the reasons that they exist. The discussion will focus on the paperwork required and the procedure to be followed. There is considerable interplay and overlap between European and UK legislature with respect to SPCs and Stewart will aim to shed light on this. Stewart will also briefly discuss the place of paediatric extensions within the SPC and patent extension framework. Following completion of the webinar, you should be able to confidently assist a colleague or client with an SPC application from start to finish, with some understanding of the implications that the case law places on this challenging topic.
