Sprint or Marathon? IP Protection and exploitation in SportsTech

We will cover discrete considerations in the sportstech space, giving an overview of legal issues and commercial issues arising in a fast-moving environment where hybrid technologies are prevalent.
This is intended to be a practical overview for practitioners and those interested in the space, not a case-law heavy exposition.

Key areas we will cover are:

  • Overview of patentability of computer-implemented inventions in the UK and Europe, including key associated technologies (sensors, AI analytics).
  • The value of data and analytics and licensing platforms and data (excluding GDPR and data protection which is outside scope).
  • Hardware and software crossover and examples of commercial methodologies.
  • Strategies for protection for major markets (consumers vs business to business).

We will not be covering medical device regulations nor other regulatory matters (including but not limited to GDPR) in this webinar.

Stephen Moore, Potter Clarkson

Stephen is a UK & European Patent Attorney specialising in hardware technologies including semiconductors, photonics and sensing systems, with a background in academic and industrial R&D. He works with clients from early-stage start-ups to international engineering teams, advising on IP strategy, drafting and prosecution, and coordinating global filing programmes. His practice also includes EPO oppositions and appeals, as well as supporting investors on IP due diligence and litigation teams in UK proceedings.

Stephen also has experience working with clients and prosecuting matters relating to sports and performance technologies, including wearable devices, sensing systems and data-driven platforms. This work involves advising on the protection of innovations at the intersection of hardware, software and analytics, often in fast-moving environments where commercial timelines and product evolution present particular challenges for patent strategy.

David Holt, Potter Clarkson

David Holt, Potter Clarkson

A partner in Potter Clarkson’s litigation and licensing team, Dave specialises in non-contentious intellectual property law, with historic experience in significant contentious patent matters. He specialises in the Life Sciences and Advanced Materials sectors, with a part of his practice focussing on the application of these technologies in sports and performance. Dave leads on IP Due Diligence services within Potter Clarkson as a core part of his practice, managing IP Due Diligence projects on behalf of investor clients, bringing together and co-ordinating multi-disciplinary teams of patent, design and trade mark experts.

Dave also has substantial experience in drafting complex, multi-jurisdictional agreements including licensing arrangements, research and development agreements and collaboration agreements, as well as providing commercially focussed IP strategy advice for his clients. This IP strategy advice particularly includes undertaking audits for clients advising on trade secret protection, policy and key terms in agreements.
