Litigation Committee

The Litigation Committee focus is to monitor, consider, advise Council on, participate in consultations on, make representations on, provide information to Members on, and make recommendations for member education and CPD on litigation and other dispute resolution procedures relating to technical intellectual property and in relation to designs, trade marks and passing off and analogous rights in the UK and other relevant jurisdictions, and/or arising in the intellectual property jurisdiction of the UK courts including by way of example, all matters related to:

  • Litigation (procedures and processes) and other forms of dispute resolution in the UK and UPC, liaison with court users’ committees.
  • Corresponding matters in other jurisdictions (such as Continental Europe, the USA, China and India) where these may impact on patent attorney practice.
  • International treaties which impact on IP enforcement or other IP disputes.
  • Where not addressed by other committees, procedures related to hearings before the UK IPO, EPO and EUIPO, including opposition, revocation, cancellation and amendments procedures.
  • Ancillary matters in connection with litigation, such as:
    • intellectual property attorney rights of audience, rights to conduct litigation and similar rights in other jurisdictions;
    • privilege and confidentiality in the context of litigation;
    • litigation funding, pro bono.
