Defensive Oppositions at the EPO – How to avoid ‘The House that Jack Built’ and be ahead of the game

Not all clients have the budget for a pending divisional for every filing, so the one EPO patent you have needs to be drafted to be as defensible as possible. You will want useable dependent claims and the option to file post-filed data in support of the inventive step. This process starts all the way back at the drafting stage. If you don’t have what you need in the granted claims you must act early to ensure your remedy is not late and thereby inadmissible. This webinar looks at claim structures that are helpful (or conversely thoroughly unhelpful) in defence and procedural steps to take before they are no longer available to you.

George Schlich is a patent and trade mark attorney (CPA, EPA, CTMA) and founded and runs Schlich from Littlehampton (“LA”) on the south coast of England. 2024 was Schlich’s 20th anniversary and the firm is 30 strong, with 15 attorneys and is growing.
