In the past, numerous Indian Courts took iron-clad stance towards Applicants for non-compliance of Section 8 as provided under the Indian Patents Act, 1970 (hereinafter referred to as the Act), which made other countries perceive India as a non-patent friendly nation. However, there is a paradigm shift over the last few years (with landmark judgements), where non-compliance of Section 8 is dealt with on the merits of each case instead of following a rigid framework.
This webinar puts forth the current judicial stance adopted by the Indian Courts and the Indian Patent Office (IPO) towards the implications of non-submission of certain bibliographic details and foreign prosecution documents of any corresponding foreign patent applications filed outside India that relate to the same or substantially the same invention as filed in India. The webinar would provide the attendees practical tips including the safest and the balanced approaches to handle this requirement in India.
