Emotional Perception & the Court of Appeal Decision CA-2024-000036

The CoA decision of 19 July 2024 re-establishes some hurdles against patentability of AI technologies, especially artificial neural networks “ANNs.” This seminar will discuss some of the implications that arise from this decision, particularly in the context of what is now considered to amount to a “computer” and indeed a “program for a computer,” and how the exclusions under section 1(2) of the UK Patents Act apply. Whilst a further appeal to the UK Supreme Court is, at the time of providing this summary (30 August), indeterminate, the presentation will look at the issues that the Supreme Court may need – or should – consider in assessing whether the present UK approach under Aerotel remains objectively similar and aligned with the EPO “any hardware” approach.
