Tuesday 17 March
Determining U.S. patent term has become significantly more complex over the years with Patent Term Adjustments (PTAs), terminal disclaimers, and obviousness type double patenting (ODP) all interacting to determine when patent protection really ends. This webinar will help practitioners learn to spot traps, calculate realistic expiry dates, and coordinate US strategy with non-US or global portfolios. In this webinar, Justin Wagner, a U.S. patent attorney and Partner at McCoy Russell LLP, will walk you through how PTA is calculated, how terminal disclaimers cap patent term notwithstanding PTAs, and how recent U.S. court decisions are reshaping ODP and patent expiry analysis. Justin will focus on practical portfolio issues for practitioners using timelines, worked examples, and prosecution scenarios to illustrate where term is gained, where it is lost, and how to communicate realistic expiry dates to clients.
