As the dynamic economies of Southeast Asia continue to build manufacturing capacity in industries ranging from pharmaceuticals to consumer electronics, patent infringement has emerged as a growing problem in the region. What options do foreign patent holders have to fight infringement in these important markets? Loc Xuan Le is a partner with Tilleke & Gibbins and heads the firm’s IP enforcement practice in Vietnam. With over 15 years of experience in IP enforcement, Loc is recognized as a leading IP attorney by Chambers Asia-Pacific, The Legal 500 Asia Pacific, WTR 1000, WIPR Leaders, and IAM Patent 1000. He has organized and overseen raids for leading clients in the pharmaceutical, automotive, high-tech and luxury goods industries, and has secured groundbreaking wins in patent infringement cases for major international pharmaceutical and agrochemical companies. In 2014, he obtained the highest award of attorney’s fees in the history of Vietnam on behalf of a U.S. based ink cartridge printer company, a case that was named Case of the Year for Southeast Asia by Managing IP magazine. Loc sits on the executive board of the Vietnam Intellectual Property Association, and is a member of the Hanoi Bar Association. He also serves as a visiting professor at some of Vietnam’s top universities and regularly publishes on IP matters.
Wongrat Ratanaprayul is the director of Tilleke & Gibbins’ Indonesia operations. She advises clients on all aspects of IP prosecution in Indonesia, as well as in multiple jurisdictions throughout Southeast Asia. Wongrat is a particularly adept patent practitioner, and is much sought-after in highly technical fields including biotechnology, pharmaceuticals, automotive, electronics, and computer-related technology. She regularly interviews inventors to derive information pertinent to drafting patent applications in life sciences and consumer products; provides opinions on freedom-to-operate analyses; routinely conducts patent and design searches; and provides clients with clear and practical patent portfolio management strategies to protect their interests. Wongrat also oversees the firm’s regulatory affairs practice in Indonesia, supervises the preparation of trademark applications, registrations, and renewals, and coordinates enforcement strategies to protect brand owners’ interests. Wongrat is admitted to the bar in Connecticut and Massachusetts and is qualified as a Thai patent agent.
